Terms of Service

1. Acceptance of Terms & Eligibility

By accessing, creating an account on, or utilizing Auto DM (“the Service”), developed, owned, and operated by BHUMI CRM (“Company”, “we”, “our”, or “us”), you agree to be legally bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

To use Auto DM, you represent and warrant that you are at least 18 years of age and hold the legal authority to connect and manage the Instagram Business or Creator account linked to the Service.

2. Integration with Meta & Instagram Graph API

Auto DM integrates with Meta Platforms, Inc. via official Graph API endpoints. Your use of Auto DM is subject to your ongoing compliance with:

• Instagram Community Guidelines
• Meta Platform Terms and Developer Policies

We are not affiliated with, endorsed, or sponsored by Meta Platforms, Inc. You are solely responsible for ensuring that your automated campaigns comply with Meta's messaging and commercial policies.

3. Acceptable Use & Anti-Spam Policy

You agree NOT to use Auto DM to:

• Send unsolicited bulk messages, spam, harassment, hate speech, or deceptive content.
• Distribute malicious software, phishing links, or deceptive promotional material.
• Mislead recipients about the identity of the account owner or send automated messages to users who have not actively interacted with your content.
• Attempt to bypass API rate limits, security measures, or Meta technical constraints.

Violation of these guidelines may result in immediate suspension or termination of your account without refund.

4. Service Availability & Disclaimers

Auto DM is provided on an “AS IS” and “AS AVAILABLE” basis. While we strive for 99.9% uptime, we do not warrant that the Service will be uninterrupted, error-free, or entirely secure.

We are not responsible for delivery delays or failures caused by Meta Graph API outages, rate limits, or changes to Instagram platform policies.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BHUMI CRM, its product Auto DM, its founders, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption arising out of your use of the Service.

6. Termination & Account Disconnection

You may terminate your agreement at any time by disconnecting your Instagram account in the Dashboard or by revoking app access in Instagram settings. Upon disconnection, we immediately cease all automated webhook processing and purge active access tokens.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
